Hello Sierra Chart Support, I am requesting written clarification regarding the permitted use of CME market data received through my current Sierra Chart / Denali Exchange Data Feed subscription. I use Sierra Chart for personal trading/research and I am developing personal analysis software which processes market data locally on my own computer. Before proceeding further, I would like to make sure that my intended use complies with my current Sierra Chart and CME market data agreements. Could you please provide written answers to the following questions: 1. Does my current subscription and CME market data entitlement permit automated processing of CME market data by external software running locally on my computer, outside of the Sierra Chart application? 2. Is my account currently classified as Professional or Non-Professional for CME market data purposes, and on what basis is that classification determined? 3. If external software automatically analyzes the CME data and generates trading signals or decision-support information, but does NOT automatically submit orders, is this considered Non-Display Usage under my current entitlement? 4. If the software later automatically submits trading orders based on that analysis, is this considered a different category of usage? If so, what additional agreement, entitlement or license would be required? 5. Sierra Chart stores received market data locally in .scid files. May I retain these raw .scid files indefinitely on my own computer for personal research and analysis? 6. Are derived features or statistics that do not allow reconstruction of the original raw market data subject to different retention or usage conditions from the raw market data? 7. Is backup of the raw .scid data and/or derived data to external storage or private cloud storage permitted under my current agreements? 8. Which, if any, of the activities described above would require a change in my Professional/Non-Professional classification, market data entitlement, agreement, or an additional license? If an additional license is required, please indicate the applicable type and current cost. For each answer, if possible, please also provide the applicable Sierra Chart or CME document, policy, agreement, or contractual provision. I am specifically requesting written clarification so that I can retain your response as a compliance reference before expanding the software beyond personal research. Our answer is that none of this is permitted. Do not use the market data provided by Sierra Chart outside of Sierra Chart, or outside of the Sierra Chart built-in functionality. You should not be able to technically do this anyway. If you do this you can be held liable for any penalties imposed by the exchanges and you have already agreed to this by the use of Sierra Chart. For what you want to do you need to contact the exchange. All of your questions need to be made to the exchange and you need to have an agreement with the exchange and obtain the data from some other provider. Not from Sierra Chart.
